In the following terms and conditions, “we”, “us”, “our”, and “ourselves” refers to Ashley Vincent Photography, “the/this website” refers to http://ghy.f48.myftpupload.com and https://www.ashley-vincent.co.uk, “you” and “your” refers to anyone accessing our website, and “customer”, “customer’s” or “customers” (as well as “you” and “your”) refers to any person making a purchase through our website.

By accessing the website we assume you are aged eighteen years or older and that you accept our terms and conditions in full. The website (and the services provided through the website) can only be used by you in accordance with our terms and conditions stated on this page, which are as follows:

Amendments

  • While we take all reasonable efforts to ensure the accuracy of information contained within this website, we do not accept any liability for inadvertent inaccuracies, errors, or omissions that may arise. Should our attention be called to any such oversight we will endeavour to make immediate rectifications. If you happen to find anything on our website that you find cause to question, please contact us and we will look into it promptly.

  • We reserve the right to amend our terms and conditions at any time and re-post them to the website. As such, we recommend that you revisit these terms and conditions whenever you use or return to this website. The amended terms and conditions will come into effect as soon as they are posted on the website.

We employ the use of cookies. By using our website you consent to the use of cookies in accordance with our privacy policy. Most of the modern day interactive web sites use cookies to enable us to retrieve user details for each visit. Cookies are used in some areas of our site to enable the functionality of this area and ease of use for those people visiting.

Third Party Sites

Our website may contain links to other third party sites, sites that we have no control over and, as such, we are not responsible or liable in any way for information, advertisements, products or other material you may find on those third party sites.

Pricing

  • All listed prices are in UK pounds sterling (aka GBP) and can be seen when clicking on each picture in our galleries then selecting a product and size.

  • In the event of a typographical or human error related to prices and sizes on our website, we are not legally bound to accept an order in this instance. If an order has been placed and paid for before such an error has been brought to our attention and duly corrected, we will contact the customer as soon as possible to advise of the situation and either offer a full refund or the opportunity to cancel and place a new order in accordance with the corrected information.

  • Although we will maintain our prices as long as possible, as and when our suppliers increase their prices we may need to adjust our prices accordingly, therefore, we reserve the right to amend our prices at any time. In the event of this happening within 24 hours of you having placed an order with us, we will refund your money as soon as possible and contact you by email to let you know. You can then decide whether or not you wish to proceed with the order at the new price.

  • Prices seen on this website may differ from prices for the same products we endeavour to sell at our events. To help cover our costs (such as travel, accommodation, pitch, etc.) of exhibiting at events, we may offer enticements by way of special offers, deals and discounts to customers purchasing on the day they see us.

  • From time to time here on the website, and in some circumstances at our events, we may issue time-limited offer codes to a customer looking to place an order with us via our website, e.g. for orders placed within 48 hours of seeing us at a show. These offer codes can only be used for online orders placed through this website, and a maximum of one offer code can be used per order. Unless otherwise specified, packaging and shipping charges will still apply to orders subject to an offer code. Further conditions may apply and if so will be published with the relevant offer code.

  • We reserve the right to reject an order where the customer uses a offer code to obtain a discount and that discount is deducted incorrectly for any reason. In this case we will offer either a full refund or ask for the appropriate payment to be made separately.

Products

Colour Variations – Image files found on our website, be they stand alone prints or photos with products, may vary in hue, saturation, and luminance (i.e. colour tones) depending on the calibration of the computer monitor or other digital device you are viewing them on. We do not guarantee that the colour tones on your screen will accurately match those of the actual print, therefore, the colour tones you see on your screen should be regarded as a guide rather than an accurate representation.

Sizes – All sizes are in inches unless otherwise stated on or by product photos. Pictures of prints, mounts, acrylic, and canvas products displayed on our website are not actual size but, where they are presented face-on (i.e. not at an angle) to the viewer, the dimensions are to scale.

Descriptions – While we make every effort to be as accurate as possible in the description of our listed products based on information provided by our suppliers, if/as and when we become aware of any inaccurate information we reserve the right to correct any such error.

Please Note – The copyright text on each individual print you will see on this website is there for copyright purpose only, and will not be seen on actual prints you are purchasing.

Ready-to-Hang Wall Art – Our wall acrylics and canvas wraps are handmade by a specialist framing company, henceforth referred to as “our suppliers”

  • Turnaround time is approximately 10 working days, from the point of our suppliers receiving the order that we place on behalf of our customer to courier delivery at the customer’s assigned address.

  • Keeping in mind that we are often exhibiting at events around the UK (mostly 2-3 days over weekends, occasionally 4-5 days over bank holidays), orders placed through our website while we are away will usually be forwarded to our suppliers between events within 48 hours of us downloading order requests and after payment has been received in full.

  • When we forward your order request on to our suppliers we will also forward your name and delivery address along with your mobile phone number. When your order is ready for dispatch, our suppliers will provide their DPD courier with your details. The DPD courier will send a text message to your mobile phone either the day before and/or on the day of due delivery. By way of that text message, by clicking on the link provided you will be able to change the date of delivery or address to be delivered to if you need to change either or both.

  • Orders placed during the run-up to Christmas may take a little longer, and our suppliers will have a cut-off date for receiving orders that need to be delivered prior to Christmas Day.

    Please contact us prior to placing your order if you want to make sure that it will arrive on or before a specific date.

  • The cost of shipping a wall acrylic up to 36” x 24” by DPD within the UK mainland is £15. For larger wall acrylics please contact us for a delivery quote. Also, for orders being sent to the Scottish Highlands, Channel Islands, Northern Island, Isle of Wight, and internationally beyond the borders of the UK, please contact us for delivery quotes.

  • Your DPD delivery will require a signature. If you are not able and/or willing to sign for your order we will not be liable for anything not received by you from us due to an item being left unattended e.g. “leave in the porch” and subsequently becoming “lost”

Other Printed Products – We use a specialist lab to produce our prints on Fuji Crystal Archive Supreme paper. Using these prints we make our own finished products, for example, mounted prints and desktop acrylic blocks.

  • To ensure that our handmade products arrive with our customers in pristine condition, we package them carefully using sturdy materials. The cost of packaging is built into the cost of shipping, which will be calculated at time of purchase and will be determined by the products and number of items ordered.

  • Once again, keeping in mind that we are often exhibiting at events around the UK (mostly 2-3 days over weekends, occasionally 4-5 days over bank holidays), orders placed through our website while we are away will usually be processed and sent out between events within 48 hours of us downloading order requests and after payment has been received in full.

  • Customers receive a confirmation email of their order having been sent on the same day. Depending on the size of the order, we use either Royal Mail 1stClass Signed For or DPD courier. UK mainland orders usually arrive with our customers within two working days.

  • For orders being sent to the Scottish Highlands, Channel Islands, Northern Island, Isle of Wight, and internationally beyond the borders of the UK, please contact us for delivery quotes.

  • Both methods of sending, Royal Mail and DPD, require a signature. If you are not able and/or willing to sign for your order, we will not be liable for anything not received by you from us, due to an item being left unattended e.g. “leave in the porch” and subsequently becoming “lost”

Ordering

  • It is rare that we find ourselves understocked with the materials we need to produce our own products, however, there may be occasions where our suppliers are short-stocked and, as a consequence, we are left waiting a little longer than usual for a delivery. If you have placed an order and we find ourselves unable to fulfil that order within the time frames stated above, we will make contact with you as soon as possible to let you know the situation. If you are not willing to wait until we can fulfil your order, then we will refund your payment.

  • When placing an order with us, you will be required to provide your name, address for delivery, your email address, mobile phone number and credit card details. We undertake to take due care with this information; however in providing us with such information you accept that we are not liable for its misuse due to error in transmission or virus or malware.

  • We reserve the right to reject or cancel any order from any person at any time. Although we are not required to provide a reason, we will most likely contact you in any case to let you know. If payment has already been made, we will certainly make contact with you and refund your payment as soon as we can.

Payment

Payments can be accepted directly through our secured online payment facility using your debit or credit card, or we can send you an invoice with our company account details for a bank-to-bank transfer. If you prefer to make a bank-to-bank transfer, please contact us by email to place your order and provide us with you full name, delivery address and phone number, and we will reply within 48 hours.

Mailing List

After your payment has been processed, you will be automatically opted in to our mailing list. If you would prefer not to receive our email updates you can opt out by way of the unsubscribe link that you will find at the bottom of any of our emails.

Cancelations & Refunds

Wall Acrylics, Canvas Wraps, Splashbacks

  • Wall acrylics, canvas wraps, and splashbacks are all bespoke products, therefore, once we have received payment and have placed a customer’s order with our supplier we cannot refund payment if you change your mind for any reason.

  • All shipments are insured. Please CHECK your delivery before signing for it. If the order has been damaged in transit, refuse delivery with the courier. If this is not possible please notify us within 48 hours so that we can start a claim process and look to reproduce your order as soon as possible.

    You should keep all packaging and/or artwork as found and notify us within 48 hours of the item arriving in damaged condition to be eligible for a claim or exchange. In most cases photographic evidence is required of any damage, in order to process a claim.

Other Printed Products

  • All printed products are carefully scrutinised prior to packaging and sending the order, however, in the unlikely event of any product arriving with you being damaged or faulty we will replace it. In such a case, you must contact us within 48 hours of your order arriving and provide us with photographic evidence of the damage or fault as well as of the packaging, if that was damaged too.

  • Once we have confirmed that the product is damaged or faulty we will send you a replacement as soon as possible. We may require you to return the damaged or faulty product to us, in which case we will provide you with a return address. Please DO NOT return any product unless we have asked you to do so in writing.

  • If you have ordered the wrong printed product, we will replace it with the order you want, on condition that you agree to pay: the packaging and shipping costs of the order you are returning; the packaging and shipping costs of the replacement order; and if the cost of the replacement order is higher than the original order, you also agree to pay the balance before we send the replacement order to you. If the replacement order costs less than the original order, we will refund you the difference by bank transfer.

  • If for any reason we are unable to replace your damaged or faulty order we will refund you the full amount for the original order, including packaging and shipping costs, by bank transfer.

Complaints

Our top priority is in keeping our customers happy, and in all areas we strive to exceed our customer’s expectations. Nevertheless, being human opens us up to making the occasional mistake or oversight, much the same as it is with our product suppliers and shipping agents.

On such occasions when dealing with our own suppliers and agents, we first give the benefit of doubt in assuming that the mistake or oversight was entirely unintentional, Secondly, we find that making courteous contact is the best way forward toward resolving any issues, and with us it is bound to be the same.

If there is anything in relation to the presentation of content on our website, the quality of our printed products, the service of shipping agents, the timeliness of our written replies, or anything else that we offer by way of service through this website that you are in any way unhappy with, please do not hesitate in contacting me personally with the assurance that I will do my utmost to resolve any issues you may have and re-convert you into the no-doubt happy customer you were before any such issue arose!

  • The photographs contained within this website that depict an animal (be that non-human or human) is an original production of Ashley Vincent Photography and, as such, is protected by copyright law.

  • Without express written consent by us, it is illegal to download, copy, redistribute, and/or republish any photograph found on this website. None of the images contained in this website may be altered, digitally copied, used in whole or in part in any manner whatsoever.

  • Removal of the Ashley Vincent Photography watermark from photographs is strictly prohibited and no image contained here may be used to form a graphical link from a website.

Licencing

  • All of our wildlife pictures are available for licence on a Rights Managed basis (not Royalty Free) for a specific usage and for a specified period. Our images have been licenced to international media companies and businesses, National Geographic Books, Samsung Display, and Sawasdee (Thai International Airway inflight magazine) being a few of the most recognisable names.

    Please send us an email to let us know which image or images you are interested in with full details of the intended use as well as how much you are willing to pay for the licence, and we will respond within 48 hours.

    Please Note: Sadly, ‘exposure’ alone does not help us to pay our bills, therefore, payment is required for image licencing.

  • If you are an artist and wish to use our images as a reference for your own renderings crafted by hand (e.g. drawings, paintings, etchings, carvings, wood-burnings, sculptures, ceramics, and needle-felting), please email us and we will send you our Picture Licencing for Artist Reference Use – Terms & Conditions.

    Note: We do not give licence to use any of our pictures for any form of digital art.

Law & Jurisdiction

  • Should a situation of Force Majeure (meaning any act, circumstance or omission over which we could not reasonably have exercised control) arise resulting in our inability to fulfil an order that has been paid for after 30 days, we may refund your payment and terminate this Agreement by giving at least seven days notice to you.

  • These terms and conditions are to be governed by and construed in accordance with the laws of England and any claim made by either party against the other which in any way arises out of these terms and conditions will be heard in England and you agree to submit to the jurisdiction of those Courts.

  • If any provision in these terms and conditions is invalid under any law the provision will be limited, narrowed, construed or altered as necessary to render it valid but only to the extent necessary to achieve such validity. If necessary the invalid provision will be deleted from these terms and conditions and the remaining provisions will remain in full force and effect.
